2007 was arguably the most extraordinary year in recent memory for the development of Private International Law. Reflecting the vitality and fluidity of a subject that is in constant motion, Volume IX of the Yearbook of Private International Law is again a very rich and multi-faceted book. An entire thematic section of this volume is devoted to the "Rome II" Regulation on the law applicable to non-contractual obligations, which was adopted by the EC institutions in July 2007. Being the first (...) EC regulation on pure applicable law issues, this text opens up a new era in the process of creating a European PIL system. It deserved therefore a detailed commentary and analysis of its main provisions by experts from several EU States. Because of the interest that this European text presents for third party States, some distinguished scholars from non-European areas (the US, Japan, Latin America and Australia) were also asked to express their views on this important piece of Community legislation and the possible influence it may have on conflict developments in their respective countries and regions. I outline a heretofore neglected difference between manipulation scenarios and merely deterministic ones. Plausible scientific determinism does not imply that the relevant prior history of the universe is independent of us, while manipulation does. Owing to sensitive dependence of physical outcomes upon initial conditions, in order to trace a deterministic history, a microphysical level of analysis is required. But on this level physical laws are time-symmetrically deterministic, and causality, conceived asymmetrically, disappears. I then consider a revised scenario to resurrect the (...) threat of manipulation even in the presence of time-symmetry and sensitive dependence upon initial conditions. To do so we posit a manipulator containing all the information of the manipulated and time-symmetrically related to him. The new scenario violates special relativity, but even waiving that objection, the scenario faces a dilemma. I argue that the manipulator either lacks agency enough to manipulate the target, or can integrate thoughts separated by long time spans into a single decision. In the latter case, the 'manipulated agent' disappears into the manipulator, making it the story of just one agent. (shrink)

In "Morals by Agreement", David Gauthier attempts to derive property rights from a moral principle called the Lockean proviso. The derivation fails, and the true implications of the moral principles which Gauthier invokes are quite different. These principles imply that persons have extensive liberties to use physical materials, but relatively few rights against interference by others in this use. Robert Nozick argues for an extensive system of property rights in "Anarchy, State, and Utopia"; his argument fails for similar reasons.
